General terms and conditions for consumers

§ 1 Scope of law

(1) These general terms and conditions include exclusively applicable requirements between you (customer) and us, run-bike24.de, business owner Christa Heinz, Krnonestrasse 8, 79618 Rheinfelden.

Conflicting or departing agreements from our general terms and conditions will not be recognized, except we agreed explicitly.

(2) Our sales personnel is not permitted to make any oral agreements with customers associated with the order form or this contract.

(3) As a customer you are a consumer required by paragraph 13 German Civil Code (BGB) as soon as the purpose of ordered items and service does not refer to a commercial or self-employed activity.


§ 2 Conclusion of contract

(1) The presentation of our products  in our shop  www.run-bike24.deis a non-binding  offer on our part. You can choose products from our assortment by pressing “into the shopping cart” button. The virtual shopping cart can be reviewed and changed at anytime by the link “shopping cart”.  The selected articles can be removed from the shopping cart by choosing the “removal” button. By pressing the “purchase order” button you agree to purchase the articles in the shopping cart at the particular time.  We will send you the acknowledgement of receipt by E-Mail which shows your order in detail. This acknowledgement of receipt does not constitute the acceptance of your offer by Laufsport Heinz. It is only an information that we have received your order.

(2) A contract conclusion between us only applies with an explicit declaration of acceptance on our side. It takes place within 4 working days by either a separate order confirmation by Email or dispatch of ordered articles. We will save the word of contract i.e. you can see all ordered items at any time in your personnel login-area and in your account.


§ 3 Price – Shipping Costs – Terms of Payment

(1)  All prices on our website include the sales tax.

(2)  If nothing else has been agreed in writing, our prices are “ex store” Rheinfelden, packaging included. Pick-up as agreed upon is also possible. Orders via the online store www.run-bike24.de will be shipped worldwide.

(3) Handling costs occur during product selection. Shall items be shipped the appropriate shipping costs will automatically occur. The invoice shows the costs as a separate item and the customer shall principally bear the costs for shipment.  If you wish another kind of shipment you shall bear all costs incurred. Orders with value of goods > 50,00 Euro are free of shipping costs in Germany and Switzerland.

(4) The sales price is due at the time the contract is confirmed. Payment takes place either with pre-payment (credit transfer) or cash on delivery, PayPal, direct banking or debit authorisation. In case of an automatic debit as well as PayPal payment we will charge your bank account the same day as the order was placed. We use the SSL-procedure to encode the transfer of your personal data.

(5) Your are only entitled to offset your own claims against ours, if these counterclaims are undisputed or legally established or recognized by us.


§ 4 Availability, Delivery

(1) In case an article you ordered is not available anymore, you shall immediately receive a notification. Is the unavailability of the product permanent, we will not confirm the order. In this case no contract will come into effect between the customer and run-bike24.de.

(2) In case an article you ordered is temporarily not available, you shall immediately receive a notification as well. If delivery is delayed by more than two weeks we will inform you right away and you have the right to cancel the order. A full refund takes place immediately in case the amount has already been paid.

(3) Our delivery and service shall be provided as soon as possible, at least within a period of 4 working days after the payment obligation has been fulfilled and unless expressly agreed otherwise or another delivery time is explicitly recorded on the product page. We also reserve the right to carry out a part delivery, as far as it appears as appropriate and reasonable for an efficient processing of the order concerned.


§ 5 Retention of title

Wes hall retail the title to all goods supplied by us until all claims have been paid.


§ 6 Warranty; Liability

(1) Should we have delivered defective articles we shall be liable in accordance with the legal regulations.

(2) For defects of factory-new merchandise, the limitation period for the consumer's rights is two years after delivery , if the goods are new and one year starting with delivery if the goods are used; this restriction shall not apply to further reclaims like injury of life, body or health.

(3) The right of the customer to claim compensation is excluded except for compensation to the customer for injury to life, body, health or from violating essential obligation of the contract, as well as liability for other damages, which are based on premeditated or culpable negligence of the provider, its representatives or agents. Material contractual obligations are defined as those whose performance is necessary for attaining the purpose of the agreement.

(4) The vendor is only liable for breach of primary contractual obligations in cases of damage of a nature that is foreseeable and typical for this type of contract and is caused by recklessness, unless the customer claims damages relating to injury of life, body or health.

(5) The restrictions of clauses 1 and 2 also apply in favour of legal representatives and performing agents for the vendor, if claims are aimed directly at them.

(6) The provisions of the product liability law remain unaffected


§ 7 Right of revocation for consumers

Right of withdrawal

You may cancel the contract, without giving any reason within 14 days or if the goods are at your disposal before the end of that period, by simply returning the shipment.

The deadline starts after the receipt of this instruction in text form (e.g. letter, fax, email), but not prior to receipt of goods at the addressee (at the recurrent delivery of similar goods not prior the first part-delivery) and also not prior fulfilment of our information duties according to article 246 §2 in connection with §1 Paragraph 1 and 2 EGBGB and our duties according to §312e Paragraph 1 sentence 1 BGB in connection with article 246 § 3 EGBGB.

To observe the revocation period it is sufficient to send off the revocation or dispatch the product in time.

Consequences of revocation:

In the event of effective cancellation, the benefits mutually received shall be returned; any benefits already realised (e.g., interest) shall be returned as well. If you are unable to return the received benefits in their entirety or partially or only in worse or diminished condition, you may have to reimburse us for the value of the benefit.  

For the deterioration of the merchandise and benefits from use, you have to pay for any damages that exceed the legitimate inspection.  A legitimate inspection is comparable with fitting and testing like it’s possible in a shop. Any merchandise eligible for shipping will be returned at our expense and risk.

You are responsible for covering the regular cost of return postage if the goods delivered are as ordered and if the price of the goods to be returned is less than € 40.00, or in case of a higher you have not provided consideration or a partial payment agreed under the terms of the contract. Otherwise, the return is free for you. Duties for the compensation of payments must be fulfilled within 30 days. The term shall begin for you when you send your declaration of revocation and for us upon receipt of such declaration.

§ 8 Shipping cost in case of exercising the right of withdrawal

Customers making use of their right of cancellation (see cancellation information) must pay the costs of the return shipment if the delivered goods match with the ordered goods and if the price of the reshipped goods does not exceed an amount of € 40.00 (incl. tax) or if the buyer of the good at a higher price has not rendered the trade-off or the contractual agreed partial payment at the time of the countermand. Otherwise the return is free for you.


§ 9 Final regulations

(1) Solely the laws of the Federal Republic of Germany shall apply for these Terms and Conditions and all legal relationships between us and the Customer. The Convention on Contracts for the International Sale of Goods dated April 11, 1980 (CISG) does not apply. Mandatory provisions of the State ofyour ordinary residence shall remain unaffected.
(2) Should individual regulations of these general terms of conditions be or become fully or partially ineffective, the effectiveness of the remaining conditions will not be affected.
